Terms and Conditions
When committing to a transaction and any future orders on this website, you, the customer, are agreeing to all the terms and conditions found below and our Privacy Policy.
When committing to a transaction we will require your email address and contact details, which we will use to update you on relevant information related to your orders and/or account. By supplying us with your email address and registering with thesuperpowders.com you are accepting that we may contact you with such relevant information.
You will be able to opt-out of any marketing communication emailed by thesuperpowders.com.
1 Making a Transaction
1.1
thesuperpowders.com is owned and operated by Superpow Ltd. When making a transaction on this website you will be agreeing these Terms and Conditions (T’s & C’s). Your respective purchase will bound by the T’s & C’s at the date of the specific order, however, a future order is made after Superpow Ltd has made updates/changes to the T’s & C’s you will be bound by those changes. We recommend you check the T’s & C’s during each purchase to acknowledge the up to date T’s & C’s. To ensure you can keep track of when T’s & C’s change Superpow ltd will show the date when they were last updated.
1.2
Your order will be confirmed and this will usually be immediately on the website or occasionally we will send an email to you to confirm the order. Your order is then bound to these T’s & C’s.
1.3
If the customer selects the Subscription option, they will be charged on the credit/debit card the provided automatically after 30 days from the original order. The customer agrees to these terms once they select the Subscription options. This Subscription can be cancelled at any time.
2 Product Price and Delivery
2.1
The price of products are advertised on the thesuperpowders.com when a customer’s order is confirmed, and any changes to this are only due to unforeseen technical issues, of which the customer will not be liable. At times thesuperpowders.com may offer time limited promotions, which may not be being offered by the time a customer creates an order.
2.2
thesuperpowders.com may include a delivery fee and this will be shown to the customer on the delivery conformation page during the transaction journey. This delivery fee will be subject to the total value the customer’s shopping basket and/or international deliveries. It is at the thesuperpowders.com discretion how and when to charge for shipping. For UK customers any order values over £30.00 GBP will be subject to free delivery, which will be reflected during checkout.
2.3
The customer must provide accurate delivery information when completing the transaction. If a correction to thr address is required, the customer must contact thesuperpowders.com within 1 hour so the correction can be applied. Contact details can be found in the footer of the website. Any consequences from an incorrect delivery address will be at the customer’s responsibility, including any additional shipping fees to re-send the product.
2.4
thesuperpowders.com will endeavour to post any orders on the same day on Mon-Fri if they are placed before 1.00pm. Orders placed after this time and days will be posted the following working day. Orders made on the weekend will be posted on the next working day
3 Methods of Payment
3.1
thesuperpowders.com accepts payments made by recognised credit and debit cards and also Paypal. The acceptable cards are shown on our website. Any changes to this will be updated in the T’s & C’s
3.2
When an order is created there will be a required ‘authority for payment’ from the customer’s card issuer. thesuperpowders.com is able to terminate the purchase agreement if the card issuer refuses authority for the respective transaction
4 Delivery
4.1
thesuperpowders.com will deliver to the address specified by the customer (this can be changed by the customer). Any incorrect details will be subject to 2.3. thesuperpowders.com reserves the right not to deliver in certain areas.
4.2
thesuperpowders.com must be notified immediately if our products are delivered to the customer in an incomplete state, damaged or the incorrect item. If the products are unused and not tampered with, thesuperpowders.com will organise with the Customer to be sent back to us. The Customer will be able to return or have the purchase value refunded of any incorrect products or product not received. For the avoidance of doubt, Superpow Ltd liability is limited to the price of the products (including delivery fee) incorrectly or not delivered.
4.3
Accepting the delivery at the stated address is the responsibility of the Customer. thesuperpowders.com respective courier partner will notify the Customer upon attempted delivery and any option for redelivery. If the Customer instructs thesuperpowders.com or the courier to leave the products at the address unattended, they expressly accept all liability to the quality (including changes due to temperature), theft, tampering and contamination.
4.4
There may be events outside of thesuperpowders.com control for reliable deliveries, such as adverse weather conditions. In these events thesuperpowders.com will endeavour to contact the Customer to reschedule a delivery. Please note Superpow Ltd liability to you will be strictly limited to the price of products not delivered, as well as the delivery fee.
4.5
In the occurrence of goods being shipped to an incorrect address and the courier being unable to locate the specified address, a refund, excluding the delivery fee, will be issued. Subsequent orders to the correct shipping address will be at the cost of the Customer
5 Faulty Products
5.1
If there is any dissatisfaction with the goods the Customer must inform thesuperpowders.com immediately via the email; support@thesuperpowders.com. If the quality of the goods is reasonably considered to be below thesuperpowders.com standards thesuperpowders.com may refund the price of the respective goods or organise for the same value replacement goods. The Customer must notify thesuperpowders.com of any dissatisfaction within 14 days of delivery. On occasion, thesuperpowders.com may require photographic indications of related product complaints to verify a full refund.
5.2
Subject to clause 7.1, we will not accept any further claims for loss connected to or from the supply of faulty goods, whether direct, indirect, consequential or otherwise, however this arises after the 14 days of delivery has surpassed.
6 Returns and Cancellations
6.1
Once an order is created thesuperpowders.com cannot make any changes unless informed within 1 hour of the transaction. The Customer has 14 days after delivery to return an unopened product for a full refund. Refunds for any returns made after 14 days will be at the discretion of thesuperpowders.com, however the Customer will be responsible for the delivery fee.
6.2
If the Customer has signed up to yet to be processed Subscription they are able to cancel this Agreement. To do so, the Customer must access their Subscription account at thesuperpowders.com. Alternatively the Customer can contact thesuperpowders.com at support@thesuperpowders.com and the team can help cancel the Agreement. When a monthly Subscription has renewed and subsequently been processed it will not be possible to cancel this respective order. However, the Subscribed order can be returned to thesuperpowders within 14 days for a full refund.com as long as it is unopened.
7 Liability
7.1
There is nothing in these Terms and Conditions which will restrict Superpow Ltd liability for personal injury or death resulting from our breach of contract, breach of statutory duty or negligence, nor will any of these terms restrict any of the Customer’s statutory rights.
7.2
If any delay or failure to perform our purchase agreement obligations are subject to circumstances beyond our reasonable control, such as Term 4.4, Superpow Ltd will not be seen to be in breach of these Terms & Conditions.
7.3
Other than noted in Term 7.1 above, Superpow Ltd maximum liability in relation to any goods ordered and supplied to a Customer under this purchase Agreement will be restricted to the price of the goods (at time of purchase) and the related delivery fee.
8 Privacy Policy
8.1
You can find a separate Privacy Policy in the footer of thesuperpowders.com.
9 Customer Complaints
9.1
We try our utmost, but mistakes happen and if unfortunately you feel thesuperpowders.com have made a mistake with your order or the quality is not up to scratch you can reach out to us at support@thesuperpowders.com. As per term 5.1 at our discretion we may need, but not exclusively, photographic confirmation of the complaint as well as the Order Confirmation and Proof of Delivery to qualify the Customer for a full refund.
10 Promotions
10.1
From time-to-time thesuperpowders.com may decide to offer special offers and/or promotions. These offers will always be subject to the same T’s & C’s. We reserve the right to change any offers or withdraw them at our discretion.
11 The Jurisdiction of the Terms & Conditions
11.1
These Terms and Conditions and any disputes or claims in connection to them and Superpow Ltd shall be governed in accordance with the law of England and Wales
12 General
12.1
All intellectual property, including but not limited to its Copyrights and registered Trademarks, across all content within thesuperpowders.com is at all times the property of Superpow Ltd. You are not permitted to publish, reporduce or exploit the works (including graphics, illustrations, deisgn and imagery) found on thesuperpowders.com without agreed consent. Superpow Ltd reserve the right to issue a charge for any use of our data or content without prior written agreement.
12.2
If any Court of Law are to determine any of the Terms and Conditions found here to be invalid or unlawful, for the avoidance of doubt, this does not affect any validity of the other Terms and Conditions, which will continue to be enforceable under the jurisdiction of the law of England and Wales.
